TrainBoston Sports Center Rules and Policies

1. HOURS OF OPERATION – Operating schedule will be subject to change from time to time, according to periodic postings in the Training Center. The Training Center may be closed on Sundays, holidays, or any other days as deemed necessary by the management. Whenever possible, the Training Center will post notices of closings or deviation from the posted hours and days of operation 1 week prior to those changes.

2. SIGNING IN/ MEMBERSHIP CARD – All Members, upon entering the Training Center, are required to check in at the main counter and show their Membership cards. Members may be required to furnish other suitable identification as requested by center personnel in order to gain entrance. In the event that a Member claims that his/her membership card has been lost, stolen or destroyed, the Training Center management may require the payment of a service fee before issuing a replacement card. This service fee shall be at the sole discretion of the Training Center management. The Training Center will not be responsible for cards left at the facility.

3. GUEST PRIVILEGES – Members are invited to bring or send their friends to the Training Center for a complete physical evaluation. Each Member, subject to the Manager’s approval, may bring or send as many guests as the Member desires. However, the same guest may not come in as a guest more than one (1) time per month, or three (3) times in any 12-month period. All guests must register at the front desk and accompany the member at all times. The Training Center management reserves the right to charge a guest fee to the Member, which will be subject to change from time to time.

4. FREEZE POLICY – Membership freezes may be allowed from time to time, at the sole discretion of the management. Freezes are not to be viewed as part of the member’s contractual privileges.

5. PERSONAL AND GROUP INSTRUCTION – All instructional courses and sessions will be taught and reviewed by the instructor. It is the Member’s sole responsibility and duty to perform only the prescribed programs set forth by the instructor. Any variation from the prescribed programs will be taken at the member’s risk.

6. CANCELLATIONS - Members are expected to keep all of their scheduled appointments. If a situation arises that will prevent you from keeping your appointment, we require a 48-hour notice of cancellation. If you notify us of your inability to keep the appointment less than 48 hours in advance, it is company policy that you will be charged for the session, unless you have a legitimate personal emergency. You will be responsible for any appointment made with one of our trainers. Please understand that there are people waiting for open spots on the schedule, and giving us the proper notice allows us to fill the time slot. We appreciate your cooperation and understanding on this matter.

7. PERSONAL TRAINING - All personal training at TRAIN Boston operates on a prepayment/punch-card system, which makes it easier for trainers and their clients to keep track of the number of remaining sessions they have left. You can purchase personal training sessions in packages of 5 or 10. We will simply subtract one session from your account each time you train, until your sessions are complete. The front desk will notify you when it is time to purchase another package and your account will be charged for the next package of sessions.

8. PARTNER TRAINING - Designed to provide training services at a reduced rate to each individual. You can receive hourly training for a lower rate per individual. However, if only one individual shows up for the scheduled partner appointment, the absent individual will still be assessed their half of the training fee. This is a commitment that you are making to your training partner as well as your trainer.

9. TIME USE OF EQUIPMENT – The Member agrees to follow designated time use of all machines and exercise areas exactly as prescribed. Maximum time use and availability will be posted on the machine or specific area, if applicable.

10. EQUIPMENT MALFUNCTIONS – The Member understands that equipment may, from time to time, be out of order. When special factory parts must be ordered, some units may be out of order for several weeks. When this occurs, the Member agrees to follow a regulated substitute program.

11. SAFETY FIRST REGULATIONS – The Member will not use a machine or other device until in proper position and will follow workout procedures exactly as prescribed by an instructor.

12. DISHONORED CHECKS, CREDIT CARD DECLINES – There will be a fee of $15 for all dishonored checks, credit card declines and insufficient funds.

13. UNAVAILABILITY OF FACILITY OR SERVICES – There shall be no right of abatement of the running of the specified term of Membership for any reason whatsoever. Failure to attend and use the facility will not relieve Members of any liability for payments and amounts due. Should the facilities or all of the services no longer be available at the location at which Member enrolls due to any reason including, but not limited to, fire, condemnation, loss of lease, act of God, catastrophe, or for any other reason, the Training Center management will have the right, subject to the Member’s rights of cancellation as set forth in the paragraphs entitled ”Consumer’s Right to Cancellation” and “additional Rights to Cancellation” on the front side hereof, to extend Member’s membership for a period of time of such unavailability, or, at the Training Center’s option, Member may be transferred to another “similar health club facility” within the same metropolitan area. In connection therewith, Member agrees that the Training Center’s entire premises may be closed or the Training Center’s location may be changed, moved, or eliminated for any reason, and Member agrees to accept the Training Center’s decision as final, unless Member has cancelled this contract and requested a refund as set forth in the paragraphs entitled ”Consumer’s Right to Cancellation” and “additional Rights to Cancellation” on the front side hereof. If a location is closed permanently, the Training Center will make every reasonable attempt to provide Members with another “similar health club facility” within the same metropolitan area.

14. NO CHILDREN ALLOWED – No one under the age of 16 will be admitted into the Training Center unless he/she is enrolled in one of the programs or courses offered by the Training Center, unless he/she has been given permission by the management, or unless accompanied by a parent or guardian. However, at the Training Center’s sole discretion, the age may change without recourse by Member.

15. COMPLIANCE WITH RULES AND CONDUCT OF MEMBER – The Member agrees to be subject to the control and guidance of the Training Center staff while on the premises and will follow instructions of Training Center personnel. The Member agrees to conduct himself/herself in a quiet, well-mannered fashion while on the premises and reserve all criticism of any kind about other Training Center members, guests, or Training Center personnel until in a private office with the Manager. The Member agrees to obey all rules and conditions of membership contained in this contract or prescribed in the future by the Training Center, and the Training Center reserves the right to revoke or terminate the membership if a Member fails to observe and obey any of such rules and conditions.

16. DAMAGE TO THE FACILITY – The Member agrees to pay for damage arising from any careless use of equipment, dropping of weights, or negligence of the Member.

17. PERSONAL PROPERTY – The Training Center, the entity owning the club, and the agents and employees of both shall not be responsible for damaged, lost or stolen articles of clothing or any other personal property of any Member.

18. AMENDING OF RULES – The Training Center reserves the right to amend or add to these rules and conditions and to adopt new rules and conditions, as it may deem necessary for proper management of the Training Center.

19. NO WARRANTIES – The Member acknowledges and agrees that no agreements, statements, warrantees or representations, expressed or implied, other than those specifically contained herein were made to the Member.

20. FACILITIES INCLUDED – Membership includes use of all of the facilities at the location shown on the face of this agreement, excluding billable services listed on the pricing sheet, unless the Member’s membership plan has provisions for including such services.

21. INCIDENTAL PROGRAMS AND SERVICES – The Member acknowledges that the Member is purchasing a membership in a physical fitness facility. The Training Center may provide, in its sole discretion, programs (such as yoga, group exercise, training camps, massage, etc.), facilities, services or equipment incidental or related to physical fitness. The Training Center shall not be required to continue any particular programs, facilities, services or equipment as part of its contractual obligations hereunder and may discontinue, change or modify the same in its sole and absolute discretion, without recourse by the Member.

22. No Members are allowed behind the front desk.

23. No alcoholic beverages or non-prescription drugs are allowed on the premises.

24. Weights, mats and other exercise equipment must be returned to their proper place after use.

25. Personal items must not be left around the Training Center or at the front desk.
